Based on negotiation of both parties, regarding entrusting items export to AJ, the Export Agency Contract is formulated as follows:
I General
Trustor agrees to entrust export agency to AJ and allows AJ to arrange work concerned.
II Documents Required
According to AJ's requirements, trustor shall provide related documents, including invoice, shipping notes and certificate of producing area, etc.
III Responsibility
- AJ is not responsible for item's quality.
- After items are shipped, confirmation and extra charge concerned shall be determined by both parties if trustor requires to cancel shipment, change destination port or transfer port, or change transportation. AJ has the right to refuse and stop such change requirements as the above if buyer has not paid off in advance. The extra cost of loss due to change shall be born by trustor.
- After ship arrives at destination, AJ will notify consignee in the home country. If items are not picked up when due, all extra charge caused at port will be born by consignee. If consignee gives up the items, trustor shall bear all charge.
- AJ charge according to its tariffs. But if buyer has any special requirements, he shall notify AJ in written form and receive AJ¨s confirmation.
IV Carriage Settlement
AJ will calculate carriage according to real conditions and notify trustor to pay.
Trustor shall pay off according to the quotation.
V. Others
1. For what is not formulated in this contract, both parties shall consult and make decisions on the basis of mutual benefits.
2. The party who intends to change the contract shall notify the other in written form ahead of time and get his approval.
3. Trustor entrusts export agency to AJ. Meanwhile, this means trustor agrees to this contract.
Once any dispute is caused, arbitration shall be undergone in the local court at the location of AJ. |
