A. About Trade
Trade contract is created after buyer submits his order. Buyer shall pay off for items and handling charge to our company as well as notify AJ. After that, buyer shall update the trade status immediately. We will notify seller to deliver items after we receive the payment from buyer. After buyer receives items and check, he shall update or confirm the trade status. Next, Buyer shall inform AJ of transferring his approved payment (excluding handling charge) to seller. After seller receives the payment, AJ¡¯s service for this trade is over.
B. About Item
As a marketplace, AJ does not play the role of a trade party. As for invoices signed between buyers and sellers, legal transfer of item copyright, quality, quantity, and functions of item, AJ is not responsible for them.
C. Buyer¡¯s Obligations
1.Buyer shall provide the following information to AJ, including but not limited to individual real name/corporation name, Email address, telephone, residence address and bank account, etc. Buyer shall ensure all the information is true, complete and valid; otherwise, all the risks, liability and loss caused shall be born by himself.
2.Buyer shall carefully keep notice of and protect his bank account and its password. For any embezzlement, illegal use of account, buyer shall immediately notify AJ and try to prevent and stop them. Any loss hereby caused shall be born by buyer himself.
3.Buyer shall often login AJ, check and update the current trade status. Buyer shall undertake any disputes, conflicts and loss caused by buyer¡¯s ignorance of trade status.
4.Buyer shall pay for items, carriage (if needed) and handling service to AJ within 10 days after trade is created. Buyer shall pay off all charge. If AJ does not receive the payment within 17 days after the trade contract is made or buyer does not pay off all charge, the contract will be cancelled and the charge already paid (if possible) will be given back to buyer.
5.Buyer shall check after receiving items from seller, and check their quality, quantity, functions and running conditions, etc.
6.Buyer shall update trade status and clearly agree or refuse to pay after system shows items have been shipped. If buyer refuses to pay, he shall contact seller soon, update trade status within 15 days and request to refund part or all of charge. If seller clearly refuses the request, buyer shall update the trade status within 15 days after his request is refused each time, and clearly consent to pay or request to refund.
7.In the period regulated in Term 6 above, it is considered that buyer consents to buy items and pay for them if he forgets or delays to update the trade status. Item charge and carriage (if needed) will be transferred to seller, and all risks, loss and liability caused shall be born by buyer himself.
8.Buyer shall contact seller, set up an agreement, and update trade status within 40 days after buyer clearly agrees or refuses to pay prescribed in Term 6.
D. Seller¡¯s Obligations
1.Seller shall provide the following information to AJ, including but not limited to individual real name/corporation name, Email address, telephone, residence address and bank account, etc. Seller shall ensure all the information is true, complete and valid; otherwise, all the risks, liability and loss caused shall be born by himself.

3.Seller shall often login AJ, check and update the current trade status. Seller shall undertake any disputes, conflicts and loss caused by seller¡¯s ignorance of trade status.
4.Seller shall deliver right items of the trade to buyer and update the trade status after noticing from the system that buyer has paid off related charge according to Part III in this regulation. Seller shall ensure quality, quantity and functions of the items he will deliver. If AJ cannot transfer buyer¡¯s payment back to seller according to the regulation and have to terminate the service hereafter prescribed due to buyer¡¯s violation of the trade contract, any liability, risks and loss caused shall be born by seller.
5.Seller shall directly deliver the items to buyer in due time through legal logistic carrier agencies (including but not limited to post office, legal express companies, etc.).
6.If buyer has the special request to appoint a carrier agency for the sake of security or quality guarantee, or need insurance, he shall negotiate with seller by himself and AJ does not undertake the responsibility for this special request.
7.Seller shall update the trade status and clearly agree with or refuse buyer¡¯s request within 15 days after buyer clearly refuses to pay or requests to refund part or all of charge.
8.In the period prescribed in Term 4 above, it is considered that seller agrees to refund item charge or carriage to buyer if seller ignores or delays checking and updating the current trade status. Accordingly, the trade contract will be cancelled and all charge paid will be returned to buyer, and all risks, loss and liability shall be born by seller himself.
9.In the period prescribed in Term 7 above, it is considered that seller agrees to buyer¡¯s request if seller ignores or delays checking and updating the current trade status. Any risks, loss and liability shall be born by seller.
10.Seller shall contact buyer within 10 days after buyer clearly agrees or refuses to pay which is prescribed in Term 6, Part III, in the regulation, make a trade contract and update trade status accordingly.
E. AJ¡¯s Liability
1.AJ shall update trade status after informed by buyer or seller, and notify them the trade status.
2.AJ shall pay part or all of item charge or carriage to seller, or refund the rest to buyer according to the current trade status, or directly cancel the service and refund all charge to buyer. All liability, risks and loss caused shall be born by both parties.
3.If AJ finds any mistake, falsity or fraud existing in information provided by both or either of buyer and seller, AJ reserves the right to immediately suspend all services prescribed in this regulation. And all risks, liability or loss caused shall be born by both buyer and seller.
4.If AJ finds buyer and seller violate ¡°Provisions on Handling Banned, Suspected or Copyright-Violated Items¡± or other regulations on banned or limited trade, or any unclarity of lawsuit, arbitration, property protection or ownership that the item is involved, AJ reserves the right to suspend the services prescribed in this regulation and all risks, liability and loss caused shall be born by both parties.
5.If both buyer and seller cannot complete the trade within 40 days after buyer clearly agrees or refuses to pay which is prescribed this regulation, and they are confronted with disputes, AJ can cooperate with an institution of solving these disputes as the third party to verify their identity only when AJ has received related certificates from this third party who has accepted to handle the disputes or from traders who has handled the disputes by themselves, under but not limited to the circumstances that buyer or seller ignores or delays fulfilling the obligations, infringes the copyright that the trade is involved or disputes on the trade, etc. And AJ will refund item charge and carriage paid to buyer¡¯s account according to buyer¡¯s request after the identity is verified. Otherwise, AJ will transfer the charge and carriage paid by buyer to seller. If AJ receives the handling plan made between buyer and seller before AJ¡¯s handling the item charge and carriage, AJ will act upon the plan. Therefore any risks, loss and liability shall be born by buyer or seller.
6.AJ will remain the disputable charge paid by buyer, which is requested by court, procuratorate, police office and other arbitration institutions, or execute the final arbitration decisions. All risks, loss and liability caused shall be born by buyer or seller.
7.Any transfer and refund of payment through AJ is free from interests.
8.All risks, loss and liability caused by user¡¯s mistakes or error inappropriate use shall be born by user himself.
F. Trade Handling Charge

G. No Warranties
The service provided by AJ, which is clearly indicated, defaulted or legitimated, is neither guaranteed nor preconditioned. Authorized by law, AJ specially makes no representations or warranties about property, marketability, applicability and non-interference.
H. Liability for Breach of Regulation
1.One party who violates this regulation and causes loss to the other party shall indemnify for the loss, including but not limited to loss, interests, and fares of lawsuit, communication, transportation, accommodation and attorney due to claim or litigation.
2.If one party violates the regulation, any proper fares caused when the other party tries to lessen the loss due to the violation shall be born by the violator. If effective measures are not adopted to lessen the loss, the violator does not indemnify for the extra losses newly come out.
I. Limitation of Liability
As a marketplace instead of a trader, AJ is not responsible for the risks of trade which shall be undertaken by both buyer and seller instead. AJ does not undertake any responsibility which shall be born by banks and/or post office. AJ will disclaim any indemnification for the damages or profit loss caused by breach (including ignorance) of this regulation.
J. Settlement of Disputes
Any disputes concerned due to breach of this regulation can be settled through mutual negotiation between AJ and user. Any party can litigate through local Court near AJ¡¯s office.
K. Applicable Laws
All state laws are applicable to settle any disputes concerned due to breach of this regulation.
L. Update, Modification & Supplement
Considering the real conditions, AJ can modify all or parts of terms in this regulation excluding special proclaims. Any updated terms will turn to effective 30 days after noticed in bulletin. |
